Terms of Use

The Site is provided for informational purposes and to facilitate talent representation inquiries. You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local laws or regulations
• Submit false, misleading, or fraudulent information
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to any portion of the Site or its related systems
• Transmit any unsolicited or unauthorized advertising, spam, or promotional materials
• Interfere with or disrupt the integrity or performance of the Site
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the Site without our prior written consent

By submitting materials through our talent submission form, you represent and warrant that:

• You are at least 18 years of age, or if under 18, that a parent or legal guardian has reviewed and consented to your submission
• You own or have the legal right to submit all content provided, including headshots, resumes, demo reels, and any other materials
• Your submission does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
• All information you provide is accurate and complete to the best of your knowledge

Submitting materials does not create a representation agreement, guarantee a response, or obligate Kinship Talent Agency to offer representation. We review submissions at our sole discretion and contact only those candidates we wish to pursue further.

You grant Kinship Talent Agency a limited, non-exclusive license to use your submitted materials solely for the purpose of evaluating your representation inquiry. We will not submit your materials to casting directors or other industry professionals without your knowledge and consent.

Kinship Talent Agency operates as a legitimate talent agency and does not charge upfront fees for representation. We earn commissions only on work we secure for represented talent, consistent with applicable state law and industry standards. Any request for upfront payment in exchange for representation is not authorized by Kinship Talent Agency and should be reported to us immediately.

All content on the Site — including but not limited to text, graphics, logos, images, audio clips, and software — is the property of Kinship Talent Agency or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and print pages from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our prior written permission, except as follows:

• Your computer may temporarily store copies of materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your web browser for display enhancement purposes

The Kinship Talent Agency name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Kinship Talent Agency. You may not use such marks without our prior written permission.

The Site may contain links to third-party websites, including social media platforms, casting databases, and industry resources. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Linking to any third-party site does not imply our endorsement of that site or its content.

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Kinship Talent Agency does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Site. Any reliance you place on such information is strictly at your own risk.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KINSHIP TALENT AGENCY, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Kinship Talent Agency and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including but not limited to any materials you submit, your violation of any third-party rights, or your violation of any applicable law.

These Terms and any dispute arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Minnesota, and you hereby consent to the personal jurisdiction and venue of such courts.

You agree that any claim or cause of action arising out of or related to use of the Site or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

We reserve the right to terminate or suspend your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the public, or for any other reason at our sole discretion.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kinship Talent Agency regarding your use of the Site and supersede all prior agreements and understandings.
